1. Acceptance of These Terms

By using WOWAZU, WAZU, or any related services—including by submitting build enquiries, forwarding WhatsApp messages to WAZU, accessing our websites or dashboards, or engaging with our builder or partner programs—you agree to be bound by these Terms of Service, our Privacy & Data Policy, and our Cookie & Tracking Policy. If you do not agree, do not use our services.

2. What WOWAZU and WAZU Are

WOWAZU is an Agentic1 venture that operates business memory layers, build enquiry systems, and related services. WAZU is the capture product within the WOWAZU ecosystem, providing a private and organised space where you can send WhatsApp messages and media by forwarding them to your personal WAZU number. We process only what you choose to forward. We do not access or scan your WhatsApp chats.

3. Eligibility

  • You must be at least 16 years old (or the minimum digital consent age in your region).
  • If using WOWAZU or WAZU for a business, you confirm you are authorised to act on its behalf.
  • Builder and partner access may be limited, staged, or by approval while the rails mature.

4. Your Account and Security

  • Your WAZU account is tied to your WhatsApp number and, where provided, your email.
  • Your WOWAZU build enquiry account is tied to your email and contact information.
  • You are responsible for securing your devices and login credentials.
  • Notify us immediately if you suspect fraud, compromise, or misuse.

5. Your Content and Permissions

5.1 You Retain Ownership

You keep full ownership of the messages, media, content, and build enquiry information you provide to WOWAZU and WAZU.

5.2 Licence You Give to WOWAZU and WAZU

To deliver the service, you grant WOWAZU and WAZU a worldwide, non-exclusive, royalty-free licence to host, store, process, index, reformat, organise and display your Content back to you only for:

  • providing digests, search, organisation, and build enquiry features,
  • maintaining and improving the service,
  • delivering tenant contexts and business memory layers, and
  • meeting legal obligations and enforcing these Terms.

This licence ends when your Content is deleted under our Privacy & Data Policy.

6. What You May and May Not Do

6.1 You Agree To:

  • Only forward Content you have the right to share.
  • Use WOWAZU and WAZU in compliance with applicable laws and WhatsApp's terms.
  • Respect others' privacy and intellectual property.
  • Provide accurate information in build enquiries.

6.2 Prohibited Uses

You must not use WOWAZU or WAZU to:

  • forward unlawful, abusive, hateful or harmful content,
  • harass or invade the privacy of any person,
  • upload malware, spyware, phishing or harmful code,
  • reverse-engineer, scrape or interfere with the service,
  • run automated mass-forwarding without written permission,
  • misrepresent your identity or business in build enquiries.

7. Plans, Limits and Service Changes

  • Different plans may include different data retention or usage limits.
  • We may adjust limits to ensure fair usage and stability.
  • We may modify, suspend or discontinue features with reasonable notice.
  • Builder and partner access may be limited, staged, or by approval while the rails mature.

8. Third-Party Services

WOWAZU and WAZU rely on third-party infrastructure such as WhatsApp (Meta), email delivery providers, cloud hosting, storage systems, OCR tools, and analytics. These providers may have their own policies and terms.

9. Intellectual Property

9.1 Our IP

All rights to the WOWAZU and WAZU platforms—including software, UI, branding, logos, and documentation—belong to or are licensed to WOWAZU and WAZU.

9.2 Restrictions

You may not use our trademarks or branding without written permission, except for ordinary references to WOWAZU, WAZU, or WAZAP.

10. Disclaimer of Warranties

WOWAZU and WAZU are provided "as is" and "as available". We make no warranties that the service will be uninterrupted, secure or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, WOWAZU, WAZU, and their directors, employees and partners are not liable for:

  • indirect, incidental, special or consequential damages,
  • loss of data, revenue, profits or goodwill,
  • unauthorised access to your data or account,
  • interruptions, errors or system failures.

Our total liability in any 12-month period will not exceed the amount you paid us in that period (if any).

12. Indemnity

You agree to indemnify WOWAZU and WAZU against claims arising from your misuse of the service or your Content violating any law or third-party rights.

13. Suspension and Termination

  • We may suspend or terminate access if you violate these Terms or pose a risk to the service or other users.
  • You may stop using WOWAZU and WAZU at any time.
  • You may request deletion of your personal data via our Privacy & Data Policy.
  • Upon termination or deletion request, we will delete your personal data within ~30 days (unless law requires longer retention).

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Courts in South Africa have exclusive jurisdiction, unless mandatory local law states otherwise.

15. Changes to These Terms

We may update these Terms. When we do, we will adjust the "Last Updated" date and provide notice if required. Continued use means acceptance of the updated Terms.
